Terms of service
Plugply is an online service reserved for businesses. These terms apply to any organization that uses it, during the free trial and after subscription.
This English version is provided for convenience. In case of discrepancy, the French version prevails: Conditions générales de vente.
1. Parties and scope
These terms of service (the "Terms") are entered into between Mickael Peyrot, French sole trader (entrepreneur individuel), SIRET 522 441 211 00011, Lieu-dit Beauvoir, 07300 Saint-Jean-de-Muzols, France ("Plugply" or "the publisher"), and any company or organization that creates an account on the service (the "Customer").
The service is reserved for professionals, within the meaning of the preliminary article of the French Consumer Code (Code de la consommation): the person creating the account declares that they are acting on behalf of a company or organization. The provisions of the Consumer Code specific to consumers, including the right of withdrawal, therefore do not apply.
The Terms are accepted upon sign-up, together with the data processing agreement, which forms an integral part of them. They prevail over any other document of the Customer.
2. Definitions
- Service: the Plugply software accessible online, its Plugins and its Application form.
- Organization: the Customer's space within the Service.
- User: a person invited by the Customer to its Organization, with the Admin or Recruiter role.
- Candidate: a person who submits an application using the Form.
- Site: the Customer's website connected to the Service, for example through the Framer Plugin.
- License: the right to use the Service, attached to the Organization.
3. Account and access
The Customer provides accurate information upon sign-up. Users sign in through a link sent to each User's email address; the Customer ensures that these addresses remain under the control of the persons concerned. Admins manage the Users, Sites and settings of the Organization, and are answerable for actions carried out from their Organization.
4. Description of the Service
The Service makes it possible to write and publish Jobs, display them on the Site, receive applications with their files there, and track them in a back office (statuses, notes, history, notifications), with GDPR compliance tools (retention period, automatic deletion, Candidate requests, record of processing activities). The Service is currently compatible with Framer sites; it may change, but no essential feature will be removed without informing the Customer at least 30 days in advance.
5. Free trial
Every new Organization benefits from a free trial of 14 days, without any means of payment. At its end, without a subscription, the Organization is suspended (section 9), then automatically closed 30 days later if no subscription is taken out.
6. Price, invoicing and payment
The price of the License is €19/month excl. VAT per Organization, i.e. €22.80 incl. VAT at the 20% rate. It covers the whole Service, with no limit on the number of Jobs, applications or Users. It is payable monthly in advance, by bank card or any other means offered by our payment provider, Stripe. Invoices are available from the Subscription page of the Service.
Plugply may change its prices by notifying the Customer by email at least 30 days before they apply. A Customer who refuses the new price may cancel before that date.
7. Late payment
If a payment fails, a Customer who has already paid at least one instalment has a grace period of 14 days, during which the Service remains available and reminders are sent. If payment is not made by the end of that period, the Organization is suspended (section 9). If the first payment fails, the Organization is suspended immediately; access is restored as soon as the payment is collected. In accordance with Article L.441-10 of the French Commercial Code (Code de commerce), any sum unpaid on the due date bears interest at a rate equal to three times the French statutory interest rate, and gives rise to a fixed indemnity for recovery costs of €40.
8. Term, cancellation and closure
The subscription is monthly, with no commitment, and renews each month. The Customer may cancel it at any time from the Subscription page: cancellation takes effect at the end of the current period, already paid, which is not refunded. The Organization is then suspended (section 9).
An Admin may also close the Organization at any time. Closure immediately and permanently deletes the Organization, its Users, its Jobs, its applications and their files, and ends the subscription without refund of the current period. Backups that still contain this data are erased no later than 30 days afterwards.
9. Suspension and automatic closure
When the License is no longer valid (end of the free trial without subscription, late payment or end of subscription), the Organization is suspended:
- the Form on the Site refuses new applications;
- the back office becomes read-only: applications remain listed, without the Candidates' names or email addresses, and their details can no longer be viewed;
- the following remain possible: subscribing, responding to Candidate requests (export or deletion of their data) and closure;
- automatic deletion of applications that have reached the end of their retention period continues.
Data is kept during the suspension and becomes accessible again as soon as the Customer subscribes or settles the payment; after a failed payment, as soon as the payment is collected. Otherwise, the Organization is automatically closed 3 months after the start of the suspension (30 days after the end of the free trial for an Organization that has never paid), after warnings by email; all its data is then deleted.
10. Personal data
For the data of Candidates and Users processed in the Service, the Customer is the controller and Plugply acts as processor, under the terms of the data processing agreement (DPA). The data that Plugply processes on its own behalf (management of the business relationship, invoicing) is described in the privacy policy.
11. Customer obligations
- Use the Service in accordance with the law, in particular employment law and the GDPR.
- Publish accurate and non-discriminatory Jobs, for whose content the Customer is solely responsible.
- Choose an appropriate retention period and handle Candidate requests, using the tools provided by the Service.
- Not harm the Service: attempted unauthorised access, sending malicious files, circumventing technical limits, resale without consent.
12. Availability and support
Plugply uses reasonable means to keep the Service permanently accessible, subject to maintenance operations, which it endeavours to carry out during low-activity hours, and to incidents beyond its control. Support is provided by email at contact@plugply.com, on working days.
13. Liability
Plugply is bound by an obligation of means (best efforts). It is not liable for indirect damage (loss of revenue, customers or recruitment opportunities), nor for the operation of third-party tools used by the Customer, such as the builder of its Site. Its total liability, for all causes combined, is limited to the sums paid by the Customer for the Service during the 12 months preceding the event giving rise to the claim.
14. Intellectual property
Plugply grants the Customer, for the duration of the License, a personal and non-exclusive right to use the Service. The Service, its Plugins and its Form remain the property of the publisher. The Customer remains the owner of its content (Jobs, settings) and responsible for the data it collects.
15. Reversibility
Until closure, the Customer can view and download its applications and their files from the Service. At its written request, before closure, Plugply helps it retrieve its data in a common format.
16. Changes to the Terms
Plugply may change the Terms. Changes are notified to the Admins by email at least 30 days before they take effect; a Customer who refuses them may cancel before that date. Otherwise, they apply.
17. Force majeure
Neither party is liable for a failure caused by a force majeure event within the meaning of Article 1218 of the French Civil Code (Code civil).
18. Governing law and disputes
The Terms are governed by French law. In the event of a dispute, the parties first seek an amicable solution, by email, for 30 days. Failing that, the dispute is brought before the competent courts within the jurisdiction of the publisher's principal place of business.
